These terms explain the agreement between you and Wits when you use the app.

By downloading, accessing, or using Wits, you agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the app.

1. who may use Wits

You must be legally able to agree to these terms. If you are below the age of legal majority where you live, a parent or guardian must review and accept these terms for you. Wits is not directed to children under 13 or the minimum age required in their region.

2. license to use the app

Wits grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, subject to these terms and the Apple Media Services Terms and Conditions.

You may not copy, sell, rent, sublicense, reverse engineer, interfere with, or misuse Wits except where applicable law expressly permits it.

3. gameplay and progress

Wits includes level-based and endless games, scores, streaks, hints, reminders, and other gameplay features. We may rebalance, add, remove, or update features to improve the experience.

Gameplay progress is stored locally and may be lost if the app or its data is deleted, a device is reset, or data becomes corrupted. Wits does not currently promise cloud synchronization or recovery of local progress.

4. advertising and rewarded choices

The free version may show automatic interstitial ads at eligible breaks between games. It may also offer optional rewarded ads for features such as an extra hint or one additional chance after a failed run.

Rewarded ads are optional. If an ad is closed early, unavailable, or fails to complete, the associated reward may not be granted.

5. lifetime ad-free purchase

Wits may offer a one-time, non-consumable lifetime ad-free purchase. After Apple verifies the entitlement, Wits will not show automatic interstitial ads while that entitlement remains valid.

Optional rewarded ads may remain available when you actively choose to receive an extra hint or continue. These are not forced and are not part of the automatic interstitial experience.

Prices, taxes, billing, refunds, Family Sharing availability, purchase approval, and restoration are handled by Apple and may vary by region. Unless required by law, refund requests must be made through Apple. A revoked or refunded entitlement may cause ad-supported features to return.

6. no medical or performance claims

Wits is an entertainment product. It is not a medical device, health service, cognitive assessment, educational certification, diagnosis, or treatment. Scores, streaks, difficulty levels, and progress should not be used to make health, employment, educational, or other high-impact decisions.

7. acceptable use

You agree not to:

  • Use Wits unlawfully or to harm another person
  • Attempt to bypass purchases, advertising controls, or app security
  • Distribute modified copies or unauthorized extracts of the app
  • Use automated systems to disrupt Wits or its service providers
  • Misrepresent your relationship with Wits

8. intellectual property

Wits, including its software, designs, artwork, game presentation, text, branding, and other content, is owned by the developer or used under license. These terms do not transfer ownership or grant permission to use Wits branding outside normal use of the app.

9. third-party services

Wits relies on services provided by companies such as Apple and Google. Their services, terms, availability, and privacy practices are controlled by them. Wits is not responsible for third-party services beyond what applicable law requires.

10. availability and updates

We aim to keep Wits available and working well, but do not guarantee uninterrupted or error-free operation. The app may be changed, suspended, or discontinued. Updates may be required to continue using some features.

11. disclaimers

To the fullest extent permitted by law, Wits is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. This includes implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

12. limitation of liability

To the fullest extent permitted by law, the Wits developer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, progress, profits, goodwill, or opportunities arising from your use of the app.

Where liability cannot be excluded, total liability will be limited to the greater of the amount you paid for Wits during the 12 months before the claim or the minimum amount required by applicable law. Consumer rights that cannot legally be limited remain unaffected.

13. termination

You may stop using Wits at any time by deleting the app. We may suspend access where reasonably necessary to address unlawful use, security risks, or material violations of these terms. Sections intended to survive termination will continue to apply.

14. changes to these terms

We may update these terms as Wits changes. The latest revision date appears at the top. Continuing to use Wits after updated terms take effect means you accept them, where permitted by law.

15. governing law

These terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles. Mandatory consumer protections and rights in your home jurisdiction remain unaffected.
